Just For Fun Software Limited (“ShopLocal,” “we,” “us,” or “our”) operates the ShopLocal.email website, web app, and related services (together, the “Service”). We are based in Strathroy, Ontario, Canada. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. It is written to comply with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), and applicable privacy laws in the regions we serve.
By using the Service you agree to this Policy. If you do not agree, please do not use the Service.
1. Who This Policy Covers
ShopLocal has two kinds of users, and this Policy applies to both:
- Shoppers – people who tap or scan a ShopLocal sign in a store and claim a free gift.
- Merchants & Organizers – businesses that participate in giveaway events, collect customer contacts, subscribe to our paid network, and (in the case of organizers) host events.
2. Information We Collect
From Shoppers:
- Contact details you enter to claim a gift – your email address, and optionally your name and phone number (a phone number is only requested if the offering shop asks for one).
- Claim activity – which gifts you claimed, when, and whether you collected them.
- Device & usage data – a randomly generated identifier stored in a cookie on your device (so we can remember your gifts without an account), your IP address, browser and device type, and pages viewed.
From Merchants & Organizers:
- Business details – business name, address, category, phone, and location, most of which are drawn from public Google Places listings when you look up your business.
- Account & contact details – the email address used to sign in (we use one-time email codes; we do not store passwords for merchant accounts).
- Billing details – for paid plans, your card is processed and stored by our payment processor (Stripe); we receive and store limited information such as the card brand, last four digits, expiry, and subscription status. We never see or store your full card number.
- Event, gift, and payout data – events you organize or join, gifts you offer, the customer contacts your gifts collect, and, for organizers in our Network Host program, commission and payout records.
Automatically, from everyone: cookies and similar technologies (see Section 7), server logs, and approximate location derived from your business lookup or IP address.
3. How We Use Information
- To operate the Service – show relevant local gifts, record claims, generate signs, and run events.
- To deliver a claimed gift – sharing your contact details with the specific shop whose gift you chose (see Section 4).
- To create and secure accounts, including sending one-time sign-in codes.
- To process subscriptions, plan changes, refunds, and Network Host commission payouts.
- To send transactional messages (claim confirmations, sign-in codes, receipts, service notices).
- To prevent fraud and abuse, including confirming that gift claims happen in person.
- To analyze and improve the Service.
- To comply with legal obligations.
4. How We Share Information
We do not sell your personal information. We share it only as described here:
- With the shop whose gift you claim (Shoppers): This is the core purpose of ShopLocal. When you claim a gift, the name, email address, and (if you provided it) phone number you entered are shared with that shop so they can welcome you and add you to their own mailing list. Your details are shared only with the shop(s) whose gift(s) you actually claim – never with the whole network. Once shared, that shop becomes an independent controller of your data and is responsible for its own marketing, which must include an unsubscribe option. You can unsubscribe from any shop’s emails at any time.
- Service providers: We use trusted vendors to run the Service, including Stripe (payment processing), Postmark (email delivery), Google Maps/Places (business lookup and mapping), and our hosting provider. They may only use your information to provide services to us.
- Legal and safety: We may disclose information if required by law, to enforce our Terms, or to protect the rights, property, or safety of ShopLocal, our users, or the public.
- Business transfers: If we are involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
5. Email and Text Messages (CASL)
When you claim a gift, you are asking the offering shop to contact you, and you consent to receive email from that shop related to your claim and their local offers. Every marketing email must let you unsubscribe. If you provide a phone number, it is shared with the shop for contact purposes; separate express consent is required before any shop sends you marketing text messages. ShopLocal itself sends you only transactional and service messages unless you have separately opted in to marketing from us.
6. Your Responsibilities as a Merchant
If you are a merchant and receive customer contacts through ShopLocal, you are an independent controller of that data. You agree to handle it lawfully, use it only for legitimate marketing to those customers, honour unsubscribe and deletion requests, and comply with CASL, PIPEDA, and all applicable privacy and anti-spam laws. ShopLocal is not responsible for how merchants use contacts once shared.
7. Cookies & Similar Technologies
We use cookies and similar technologies to:
- remember your claimed gifts without requiring an account (a long-lived random identifier);
- keep you signed in to a merchant dashboard;
- recognize returning visitors and maintain sessions; and
- understand usage so we can improve the Service.
Most cookies we use are strictly necessary for the Service to function. You can disable cookies in your browser, but some features (such as remembering your gifts) will not work.
8. Data Retention
We keep personal information for as long as needed to provide the Service and for legitimate business or legal purposes. Shopper claim records are retained while your identifier remains active; merchant and billing records are retained for the life of the account and for the period required by tax and accounting law. You may request deletion as described below.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections (HTTPS) and processing of card data entirely by our PCI-compliant payment processor. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your Privacy Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you;
- Correct inaccurate or incomplete information;
- Delete your information, subject to legal and contractual limits;
- Withdraw consent or opt out of marketing at any time; and
- Complain to a privacy regulator, such as the Office of the Privacy Commissioner of Canada.

11. Children
The Service is not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has provided us information, contact us and we will delete it.
12. International Users & Data Location
We operate from Canada and use service providers that may process data in Canada, the United States, and elsewhere. By using the Service you understand that your information may be processed in these locations, which may have different data-protection laws than your own.
13. Changes to This Policy
We may update this Policy from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
